Job Description:

ESSENTIAL JOB FUNCTIONS

Oversees the compliance program by reviewing cases submitted by the compliance investigators on EO, Fair Housing, and Fair Housing Complaints. Maintains required reports and appropriate records on investigations, findings and agreements.

Conducts studies, independent research, and surveys and makes recommendations on systemic issues within the organization and recommendations based on developments in Equal Opportunity to the EO Director.

Reviews ordinances and EO policies for amendment/adoption.

Assigns cases to Compliance Investigators and ensure that staff follows outlined investigation process.

Conducts studies and collects information to evaluate employment practices. Conducts studies on proposed ordinances to minimize the impact the ordinances may have on disadvantaged communities.

Consults with department heads to evaluate and monitor equal opportunity needs and diversity/inclusion strategy. Assists departments in the administration of equal opportunity and complaint procedures. Consults with public and private agencies and organizations to develop policies and proposals for new equal opportunity programs and systems. Formulates equal opportunity policies and operating procedures.

Supervises and coordinates the activities of subordinate employees, including determining work procedures and schedules; issuing instructions and assigning duties; reviewing work; recommending personnel actions; conducting performance reviews; and conducting departmental training and orientation.

Supervises the staff of Compliance Investigators who enforce the City of Gainesville’s Chapter VIII ordinance pertaining to fair housing, equal employment, public accommodation, credit discrimination internal EO Policies.

Fair Chance Hiring Ordinance

The City of Gainesville has adopted a Fair Chance Hiring ordinance. The ordinance prohibits employers from making statements related to criminal history in job postings and recruitment materials. The ordinance also prohibits employers from asking about or considering information about an individual’s criminal history until after the employer has made a conditional employment offer, unless an exemption applies. An employer must comply with the specific requirements of the ordinance prior to withdrawing an individual’s conditional employment offer if the employer’s reasoning for withdrawing the employment offer is based on the individual’s criminal history.

The Compliance Manager oversees the investigation of complaints made pursuant to the Fair Chance Hiring ordinance. The Compliance Manager also oversees the issuance of civil fines and the administering of training sessions for employers who violate the ordinance.

Develops equal employment, sensitivity, and awareness training for individuals of diverse backgrounds, including elected officials, charter officers, department heads, representatives of other agencies, other City employees, and the general public

May draft settlement agreements.

Develops compliance training and recommends proactive measures to mitigate future violations or non-compliance.

Recommends the selection, transfer, promotion, discipline or discharge of assigned employees.

Conducts performance evaluations and recommends approval or disapproval of merit increases.

Possess excellent written and oral communication skills as demonstrated by the ability to articulate information and issues clearly and concisely.

Possess excellent customer service, time management, and organizational skills.

Attends work on continuous and regular basis.

NON-ESSENTIAL JOB FUNCTIONS

Gainesville Human Rights Board

Serves as staff liaison to Gainesville Human Rights Board or special committees assigned by the EO Director.

As staff liaison to the Gainesville Human Rights Board, the Compliance Manager’s duties include, but not limited to:

Ensuring the reservation of the City Hall Auditorium for board meetings and/or securing an alternative location if the City Hall Auditorium is unavailable

Ensuring that the meeting site, meeting agenda, and the meeting materials are uploaded and properly posted in the City of Gainesville’s escribe system

Ensuring that a quorum is secured at least two weeks in advance of the scheduled monthly board meeting

Ensuring that the Investigative Report(s), post-meeting minutes, meeting agenda, and other relevant meeting materials are provided to the board members, the assigned City Attorney, the EO Director, and Compliance Team at least one week in advance of the scheduled meeting

Coordinating a Gainesville Human Rights board member orientation between the Compliance Manager, the EO Director, and the new board member(s)

Coordinating with the City of Gainesville Communications Department to ensure that the board meetings are recorded and/or broadcasted pursuant to Florida’s Sunshine Law (Florida Statute 286.011)

Inscribing minutes during each monthly meeting

Maintaining board member attendance records

Ensuring that meeting minutes and board member attendance records are recorded in escribe

Monitoring board member term limits and board vacancies

May act in the absence of the EO Director.

Performs other related duties as assigned.

QUALIFICATIONS

To perform this job successfully, an individual must be able to perform each essential job function satisfactorily. Below are the required education, experience, knowledge, skills and abilities to perform the essential functions.

EDUCATION AND EXPERIENCE

Bachelor degree from an accredited college or university with major course work in public or business administration, human resources management, pre-law, or related subject and (3) years of progressively responsible experience in the Equal Opportunity, Fair Housing, and/or Diversity fields or an equivalent combination of education, training and experience which provide the required knowledge, skills and abilities.

CERTIFICATIONS OR LICENSES

Licenses

State ID required at the time of appointment.

Certifications

Must acquire, within twelve (12) months of appointment, certification at Level I by the Florida Association of Code Enforcement (FACE). Must maintain certification, throughout employment, by receiving required continuing education units.

KNOWLEDGE, SKILLS AND ABILITIES

Understanding of policy and context and the role of local government.

Proficiency with technology, and the ability to learn new skills and systems.

Thorough and considerable knowledge of city codes, ordinances, state statues, developments, and policies and procedures as they relate to the responsibilities of this position.

Knowledge of conflict resolution techniques, as well as legal implications of discrimination investigations.

Knowledge of investigative principles, methods and techniques, and case management principles for the purpose of preserving evidence and establishing documentation.

Demonstrated intermediate level knowledge of personal computers and Microsoft Office Suite.

Possess self-aware, self-motivated, reflective, and adaptive skills that include the ability to fulfill a variety of functions in a team environment with little supervision.

Ability to develop, deliver, and monitor discrimination and harassment training and education.

Ability to interact collaboratively and productively and to build effective relationships with individuals of diverse backgrounds, including elected officials, charter officers, department heads, representatives of other agencies, other City employees, and the general public.

Ability to develop long-term and short-term plans and programs to evaluate work accomplishments.

Ability to organize and evaluate information.

Ability to effectively handle multiple tasks and balance competing priorities. Ability to effectively lead a team and work as a member of a team.

PHYSICAL AND ENVIRONMENTAL REQUIREMENTS

To perform this job successfully, an individual must possess certain physical abilities and be able to withstand work related environmental conditions.

PHYSICAL REQUIREMENTS

While performing the duties of this Job, the employee is often required to sit for prolonged periods of time.

WORK ENVIRONMENT
